This Website Privacy Notice (“Notice”) explains how Scuba Sense Inc. (“Scuba Sense,” “we,” “us,” or “our”) collects and uses personal information when you visit scubasensepro.com (the “Website”) or submit our Early Access sign-up form (the “Form”).
This Notice covers the Website only. If your business is onboarded to the Scuba Sense Pro platform, the Operator Privacy Policy provided to you at onboarding governs your use of the platform. Divers invited to the Scuba Sense diver application are covered by the Diver Privacy Policy presented in that application.

When you submit the Form, you provide:

When the Form is submitted, our systems also record:
- IP address of the device used to submit the Form
- Browser and device information (the “user agent” your browser sends)
- The date and time of your submission, and whether our confirmation emails were sent
1.3 Information received when you visit any page
When your browser loads the Website, your IP address and standard browser details are received by the service providers that deliver the page to you: our website host, the provider of the Website’s typeface, and the provider that stores the Website’s images. These are described in Section 4.
1.4 What we do not do
- We do not set our own cookies on the Website.
- We do not use website analytics, advertising pixels, or cross-site tracking technologies on the Website.
- We do not sell your personal information, or share it for cross-context behavioral advertising.
Section 2 — How We Use Your Information
We use the information described above to:
- Review your Early Access request and contact you about it
- Send you a welcome email and occasional updates for dive operators about Scuba Sense. Every such email includes a link to unsubscribe.
- Notify our team that a new request has arrived
- Protect the Form from spam, bots, and abuse, including by verifying that a submission comes from a person and by limiting repeated submissions from the same IP address
- Comply with applicable law and respond to lawful requests
Early Access Feedback and Product Improvement
During Early Access, Scuba Sense Inc. may use feedback you provide to refine the Scuba Sense platform’s features and user experience. Scuba Sense Inc. does not use Early Access feedback or personal information collected through the Website to train external or third-party artificial-intelligence or large-language-model systems.
Section 3 — Legal Bases for Processing (EEA, UK, and Switzerland)
If you are located in the European Economic Area, the United Kingdom, or Switzerland, we rely on the following legal bases:
- Consent — to send you emails about Scuba Sense. You may withdraw consent at any time by unsubscribing or contacting us.
- Legitimate interests — to respond to your Early Access request, operate the Website, and keep the Form secure. Our interests do not override your rights; you may object at any time (Section 7).
- Legal obligation — where we must retain or disclose information to comply with law.
Section 4 — Service Providers
Scuba Sense Inc. engages a limited number of trusted third-party service providers to support the operation, maintenance, and security of the Website. These service providers may assist with functions including database infrastructure, spam and bot protection, email delivery, file and media storage, website hosting, and font delivery.
Scuba Sense Inc. may update or replace its service providers from time to time as its business needs evolve. Any such service providers will be engaged only as necessary to perform services on behalf of Scuba Sense Inc. and will be contractually required to protect personal information in accordance with applicable data protection laws and maintain appropriate confidentiality and security safeguards.
All service providers are engaged under written agreements restricting their use of personal information to the purposes for which it was shared, imposing appropriate security obligations, and prohibiting any secondary use or onward disclosure.
We may also disclose information where required by law or legal process, to protect the rights, property, or safety of Scuba Sense or others, or in connection with a merger, acquisition, or sale of assets, subject to this Notice.
Section 5 — International Transfers
Scuba Sense and its service providers are located in, and process information in, the United States. If you visit from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country. Where required, we rely on appropriate safeguards for these transfers.
Section 6 — How Long We Keep Information
- Form submissions (email address, role, website, IP address, and browser details): kept 36 months after we last contacted you, unless you request to be deleted sooner.
- Spam-protection counters, which record your IP address to limit repeated submissions, are temporary and are routinely cleared.
- Unsubscribe records are kept so that we continue to honor your choice.
- Service provider logs are kept according to each provider’s own schedule.
Section 7 — Your Choices and Rights
7.1 Unsubscribing
You can stop receiving our emails at any time by using the unsubscribe link in any email, or by writing to privacy@scubasensepro.com.
7.2 Your rights
Depending on where you live, you may have the right to:
- Know what personal information we hold about you, and receive a copy of it
- Correct information that is inaccurate
- Delete your information
- Object to or restrict our use of your information, and withdraw consent
- Receive your information in a portable format
7.3 California Residents — CCPA
If you are a California resident, you may have additional rights under the CCPA/CPRA, including the right to know, correct, delete, and opt out of the sale or sharing of personal information. Scuba Sense Inc. will respond to verifiable CCPA requests within forty-five (45) days of receipt, extendable by a further forty-five (45) days with notice.
We do not sell or share personal information as those terms are defined under California law, and we do not collect sensitive personal information through the Website.
7.4 Submitting a Request
To exercise any privacy right, submit a written request to privacy@scubasensepro.com with the subject line “Website Privacy Rights Request.” Scuba Sense Inc. may require verification of the requestor’s identity before fulfilling the request. There is no fee for submitting a privacy rights request, and Scuba Sense Inc. will not discriminate against anyone for exercising any right described in this Section 7. A California resident may use an authorized agent to submit a request on their behalf. Where a request is made by an authorized agent, Scuba Sense Inc. may require the agent to provide proof of written authorization and may require the individual to verify their own identity directly with Scuba Sense Inc. or to confirm that they granted the agent permission to make the request.
Section 8 — Do Not Track and Global Privacy Control
We do not track visitors across websites, so we do not change the Website’s behavior in response to Do Not Track signals. We treat a Global Privacy Control signal as a request to opt out of the sale or sharing of personal information; as described above, we do not sell or share personal information.
Section 9 — Security
Scuba Sense Inc. implements and maintains technical and organizational security measures designed to protect personal information collected through the Website against unauthorized access, disclosure, alteration, or destruction. These measures include encryption of personal information in transit and at rest, and restricted access by Scuba Sense Inc. personnel to authorized individuals only. No method of transmission or storage is completely secure.
Section 10 — Children
The Website is intended for dive businesses and their professional staff. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has submitted information through the Form, contact us at privacy@scubasensepro.com and we will delete it.
Section 11 — Changes to This Notice
We may update this Notice from time to time. When we do, we will change the “Last revised” date above, and where the changes are material we will provide notice on the Website.
Section 12 — Governing Law and Privacy-Rights Residency
This Notice is governed by the laws of the State of Arizona, United States of America.
Notwithstanding the choice-of-law provision in this Notice (or in any underlying agreement), the privacy rights, protections, and obligations that apply to any individual are determined by the privacy laws of that individual’s state (or country) of residence. The governing-law clause of this Notice does not limit, displace, or override any consumer-privacy right granted to an individual by their state or country of residence.
